Conflicts of interest

Telefónica has a Conflict of Interest Regulation that seeks that, in development of the principle of integrity, our collaborators act objectively and impartially in each of their actions.

  • Conflict of interest: When a direct or indirect Personal Interest of a collaborator influences, could influence, or generates the perception of being able to influence, their professional decisions, which could conflict with the interests of Telefónica.
  1. Real (Influences)

    Example: A friend of a service analyst arrives to make a claim and asks him to let him go first in line. in the system.

  2. Potential (Could influence)

    Example: The spouse of a collaborator is linked to Telefónica and although they are not working in the same area, it is possible that they will transfer him and sell the same products as her.

  3. Apparent (Generates the perception of being able to influence)

    Example:Two cousins are linked to Telefónica and although they do not have a close relationship, nor do they interact in the exercise of their functions, they have the same last name and frequently appear in photos of family reunions.

Telefónica employees can report their conflicts of interest through the declaration tool available on the intranet.

However, any third party that is aware of the existence of a conflict of interest that may go against the interests of Telefónica Colombia, may communicate it to the Compliance Department by email ofc.cumplimiento.co@telefonica.com or our reporting channels

Some useful questions that can help you identify the existence of a conflict of interest are the following:

1. If they are internal employees

 Is there a hierarchical dependency between them?

Are their functions related by dependency in such a way that it can benefit the self-interest of any of those involved?

Is there any other situation that could generate the risk that any of the employees could benefit in some way to the detriment of Telefónica’s interests due to the relationship?

2. In the case of third parties

Is there supervisory responsibility between the Telefónica employee and the third party in any way?

Is it possible to generate any profit, perks or personal benefit due to the power exercised by the employee in Telefónica with respect to said relationship?

If the employee is involved in any commercial transaction with Telefónica in addition to his work as an employee, can he benefit from the functions he performs?

Are the activities carried out by the third party in competition or conflict with the products and services offered by Telefónica or are they detrimental to the best interests of Telefónica?

Could the situation generate a direct or indirect interest on the part of the employee that is potentially detrimental to the interests of Telefónica?

If it is a relationship with the competition, is there an affinity between the functions performed by the people involved?

Is there any risk to the confidentiality of Telefónica’s information?

Is there any other situation that could generate the risk that the employee could benefit or benefit a third party in some way to the detriment of Telefónica’s interests due to the relationship?
